Terms and conditions
Mondo Pet is a project and brand of PhytoItalia S.r.l.
The contract between PhytoItalia S.r.l. (also referred to as “the Company”) and the Customer is considered concluded with the acceptance, even partial, of the order by PhytoItalia S.r.l.
Such acceptance is considered implicit unless otherwise communicated to the Customer through any means. By placing an order through the available methods, the Customer declares to have read all the provided information during the purchase process and to fully accept the general and payment conditions.
If the Customer is a consumer (i.e., a natural person purchasing goods for purposes unrelated to their professional activity), once the online purchase procedure is completed, they shall print or save an electronic copy and, in any case, retain these general sales conditions, in compliance with Articles 3 and 4 of Legislative Decree 185/1999 on distance sales.
The Customer has no right to claim compensation or indemnity and cannot hold PhytoItalia responsible for any direct or indirect damage to people and/or things caused by the non-acceptance, even partial, of an order.
SCOPE OF APPLICATION
These General Conditions are an integral part of any proposal, purchase order, and purchase confirmation of the Products sold through the online store phytoitalia.it, through which PhytoItalia intends to market its product range.
CONTRACT FORMALIZATION
The purchase process follows these steps:
By sending the order, the Customer submits an online purchase proposal for the selected products to phytoitalia.it. Sending the purchase order implies consent (pursuant to Article 10 of Legislative Decree 185/1999) to receive further communications from phytoitalia.it, aimed solely at concluding and executing the sales contract.
phytoitalia.it reserves the right not to accept incomplete or improperly completed orders.
phytoitalia.it confirms receipt of the purchase request via email, containing information about sales conditions in compliance with Article 4 of Legislative Decree 185/1999. The order confirmation serves as acceptance of the purchase proposal.
The contract is considered binding for both parties when the purchase order confirmation is sent to the Customer.
If the Customer’s order exceeds the available stock, phytoitalia.it will fulfill the purchase only within the available stock. The Customer Service team will inform the Customer (via phone, fax, or email) whether the ordered products will be available in the future.
DELIVERY TIMES AND METHODS
PhytoItalia delivers the selected and ordered products according to the method chosen at the time of purchase. In any case, the delivery times, pursuant to Article 6 of Legislative Decree 185/1999, shall not exceed 30 days from the day following the order transmission.
Shipping is charged for purchases up to €120. For orders exceeding €120, shipping is free.
The total shipping cost is specified under “Shipping Costs.”
Delivery is subject to the Customer’s payment using one of the available methods on phytoitalia.it, detailed under “Payment Methods.” Any delivery conditions different from those stated in the General Conditions must be previously agreed upon in writing (email) between the Customer and phytoitalia.it.
The invoice is issued by phytoitalia.it upon request and is delivered to the Customer at the time of delivery, either with the transport document or electronically via email.
PRICES
All product prices on the website are in Euros. Unless otherwise stated, product prices include VAT and all other applicable taxes. Product prices indicated on the website supersede any previous prices.
SITE LIABILITY
phytoitalia.it is not responsible for service disruptions due to force majeure events beyond its control, including but not limited to government actions, strikes, and other unforeseen circumstances.
CUSTOMER OBLIGATIONS
The Customer agrees to print and retain these General Conditions after completing the online purchase. These conditions must be reviewed and accepted before submitting a purchase order to comply with Articles 3 and 4 of Legislative Decree 185/1999. Acceptance occurs by selecting the appropriate checkbox on the website. Without this, the order cannot be processed.
RIGHT OF WITHDRAWAL
Consumers have the right to withdraw from any distance purchase within 14 working days and receive a full refund without penalties, as per Legislative Decree 185/1999. The only non-refundable expenses are shipping costs.
The EU regulation states that only private individuals (consumers) acting for non-commercial purposes can exercise the right of withdrawal. Businesses, legal entities, and resellers are not entitled to this right. The right of withdrawal also does not apply to food items that cannot be returned or risk deterioration.
The Right of Withdrawal, therefore, CANNOT be exercised by legal entities and individuals acting for purposes related to a commercial activity. Purchases made by resellers or by individuals who purchase for resale to third parties in any capacity are also excluded from the right of withdrawal. The right of withdrawal does not apply to the supply of food products that, by their nature, cannot be returned or risk deterioration or rapid alteration.
PAYMENT METHODS
Customers can pay for their orders via:
1. PayPal for users with a PayPal account.
2. Credit or prepaid card via PayPal for users without a PayPal account.
Payments are processed before shipment.
OFFERS, PROMOTIONS AND GIFTS
Offers on phytoitalia.it are valid while stocks last. Promotions are not cumulative. Promotional products may be delivered in special packaging different from those shown on the website.
If a promotion includes a free product, the Customer accepts it by default. Gifts are available while stocks last and cannot be exchanged or returned.

DISPUTES
Any dispute related to the execution, interpretation, or breach of the online contract between the Customer and phytoitalia.it falls under Italian jurisdiction. The competent court is the Court of Novara.
APPLICABLE LAW
Contracts concluded online with phytoitalia.it are governed by Italian law. Any matters not explicitly covered by these Terms will be governed by applicable Italian legal provisions.
In accordance with Articles 1341 and 1342 of the Italian Civil Code, the Customer declares they have read and expressly accepted these sales conditions.
